How to Apply for Settlement

1. Settlement requires both parties (or their representatives) and a witness.

2. You can apply for mediation through the mediation committee, which will draft a settlement agreement free of charge and submit it to the court for certification.

3. Express your willingness to settle to the police handling the case, and request a police officer to act as a witness.

4. Settlement agreements should include a clause stating that the other party waives their rights to pursue civil or criminal charges.

5. If you have additional insurance, the insurance company may assist with the settlement process when filing a claim.

6. Private settlements should ideally have insurance company approval to avoid disputes with the insurer.

7. Settlement agreements certified by the court have the same effect as court judgments.

8. Valid settlement agreements are legally binding, requiring both parties to fulfill their obligations.

9. There is no fixed format for a settlement agreement. It must bear the seals of both parties and the witness, along with the settlement details and date.

10. Authorized representatives require a written authorization or consent form from family members to act on their behalf.

11. Agreements signed by unauthorized representatives are invalid.

12. If a party dies, the representative must be authorized based on inheritance priority (spouse >> children == parents >> siblings).
